Terms of Service

DishCapture, operated by Infinity Holdings Group Limited (“we”, “our”, or “us”) provides a mobile application that allows users to capture, organize, and manage recipes. These Terms of Service govern your use of the DishCapture app and related services.

1. Acceptance of Terms

By accessing or using DishCapture, you agree to these Terms of Service and our Privacy Policy.

If you do not agree, you may not use the app.

2. Description of Service

DishCapture allows users to:

  • Capture recipes from images, links, text, or voice

  • Convert them into structured formats

  • Save, edit, and organize recipes

We may update, modify, or discontinue features at any time.

3. Accounts

You may create an account to access certain features.

You agree to:

  • Provide accurate information

  • Keep your login credentials secure

  • Be responsible for all activity under your account

4. Free and Paid Services

DishCapture offers both free and paid features.

Certain features may be available at no cost, while others may require a one-time purchase or subscription.

Pricing, features, and limits are subject to change at any time. Current pricing will be displayed within the app or through the applicable app store.

5. Payments and Billing

  • All purchases are processed through third-party platforms such as Apple App Store or Google Play

  • Payments are non-refundable except where required by law

  • Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period and you will retain access until that date. We do not offer refunds for unused portions of a subscription period except where required by law.

  • Users are responsible for managing subscriptions through their app store account

We do not store or process payment details directly.

6. User Content

You retain ownership of the content you submit, including recipes, images, and text.

By using DishCapture, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Process your content to provide the service

  • Store and display your content within the app

  • Use your content to improve functionality and user experience.

7. Data Retention

We retain your account data for as long as your account is active. If you delete your account, we will permanently delete your personal data within 30 days, except where we are required to retain it for legal or compliance purposes. Recipe data stored locally on your device will remain until you uninstall the app.

8. Marketing Communications

We will only send you promotional emails or marketing communications if you have explicitly opted in during registration or through your account settings.

You can unsubscribe from marketing emails at any time by:

  • Tapping the unsubscribe link in any marketing email we send you

  • Updating your preferences in the app under My Account

We will never share your email address with third parties for marketing purposes.

9. Content Sharing and Competitions

DishCapture may allow users to share recipes externally (for example, by inviting others to access the app).

At this time, recipes are not publicly visible to other users within the app unless explicitly shared by you.

From time to time, DishCapture may offer competitions, featured content opportunities, or promotional activities.

If you choose to participate in these features, you may be asked to grant permission for your submitted content (such as recipes, images, or descriptions) to be:

  • Displayed within the DishCapture platform

  • Shared with other users

  • Used in marketing or promotional materials related to DishCapture

This permission will always be requested as a separate opt-in and will never be assumed by your use of the app. Where content is featured or shared, DishCapture may identify you using your display name (such as your first name or username), but will not publicly share personal information such as your email address.

Your content will only be used in these ways if you have provided your consent.

10. Acceptable Use

You agree not to:

  • Upload unlawful, harmful, or misleading content

  • Infringe on intellectual property rights

  • Interfere with the operation or security of the app

We may remove content or suspend accounts if necessary.

11. Intellectual Property

All branding, design, and technology associated with DishCapture are owned by us.

You may not copy, modify, distribute, or reverse engineer any part of the service without permission.

12. Third Party Services

DishCapture may rely on third-party tools, including AI and data processing services.

We are not responsible for the performance or practices of third-party providers.

13. Termination

We may suspend or terminate your access if you violate these Terms.

You may stop using the service at any time.

14. Disclaimers

DishCapture is provided “as is” without warranties of any kind.

We do not guarantee:

  • Accuracy of extracted recipes

  • Continuous or error-free service

In particular, AI-extracted recipe content — including ingredients, quantities, cooking times, and instructions — may contain errors. You are responsible for verifying all recipe details before use, especially in the context of food allergies, dietary requirements, or medical conditions.

15. Limitation of Liability

To the maximum extent permitted by law, DishCapture is not liable for:

  • Data loss

  • Errors in content

  • Indirect or consequential damages

16. Changes to Terms

We may update these Terms from time to time.

Any changes will be posted on this page with an updated effective date.

17. Dispute Resolution

If you have a concern or dispute relating to these Terms or your use of DishCapture, we encourage you to contact us first at info@dishcapture.com so we can try to resolve it informally.

If we are unable to resolve the dispute informally within 30 days, either party may refer the matter to mediation in Hong Kong before initiating formal legal proceedings. Both parties agree to participate in good faith in any such mediation.

Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction.

18. Governing Law

These Terms are governed by the laws of Hong Kong Special Administrative Region. Any disputes arising from these Terms or your use of DishCapture will be subject to the exclusive jurisdiction of the courts of Hong Kong.

19. Your Privacy Rights

Depending on where you live, you may have the following rights regarding your personal data:

  • The right to access the data we hold about you

  • The right to correct inaccurate data

  • The right to request deletion of your data

  • The right to export your data in a portable format

  • The right to withdraw consent for marketing communications or promotional use of your content at any time

To exercise any of these rights, please contact us at info@dishcapture.com. We will respond within 30 days. If you are located in the EU or UK, you also have the right to lodge a complaint with your local data protection authority. We will respond to all data requests within 30 days of receipt.
